Delta 8 THC Georgia Laws: Is Delta 8 THC Legal in Georgia?

According to the action filed by Pate, Johnson & Church, District Attorney Patsy Austin-Gatson stated in January that the ownership, sale, or diffusion of delta-8 is illegal under state law. The district attorney’s office did not respond to an email sent on Friday.

According to the lawsuit, the district attorney misinterpreted “hemp” and “hemp products” under state law. It seeks a court order prohibiting Austin-Gatson and the state from prosecuting business owners for selling delta-8 and delta-10 items and a certification that they are legal.
